Not an official response: As long as the template is 100% created by him/form him and does not depend in any way on any other code from any other of the templates, I'd say there is no problem.
But what does user want to "copyright" anwya? CSS code? Colors? Good luck.

HTML must still in GPLv3 (except if tottally rewritten)
Theme can have a different copyright.

Second question is "theme" vs "template". After renaming the html/css/js collection from template into themes (since LS3), a template can be a questionnaire and the theme the optical stuff.

You are right, of course, but one cannot always know where his/her users come from.
Of course we could ask each of them but we'd like to define a common policy.
